1. Acceptance of Terms
By downloading, installing, or using Daubby ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App. These terms constitute a legally binding agreement between you and Cynfi LLC ("Cynfi," "we," "us," or "our").
2. Description of Service
Daubby is a scorekeeping aid for players of physical paper bingo cards. It uses your device's camera to read cards you already own, helps you track numbers you tell it have been called, and highlights cards that are close to a win. The App stores all data locally on your device. You acknowledge that your scanned cards, game history, and settings will be irrevocably destroyed if the App is uninstalled.
Daubby is not a game of bingo, does not host or conduct any game, and does not accept, process, or pay out wagers of any kind. It is an assistive tool used alongside a game run by someone else.
3. License
Cynfi grants you a limited, non-exclusive, non-transferable, revocable license to use Daubby for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code or the card-recognition models it uses.
4. Free Trial and Purchase
Card scanning is free to use for 60 days, counted from the first time you save a scanned card in Daubby. Installing or opening the App does not start the trial. After the trial ends, unlocking card scanning is a single one-time purchase. There is no subscription, no recurring charge, and no additional purchase after it.
Party mode, which deals randomly generated cards, is free and stays free. It is not limited by the trial and does not require the purchase.
The purchase is processed by Apple through the App Store, under Apple's terms and payment methods. Cynfi LLC does not handle or receive your payment details. Refunds are handled by Apple, not by us; requests should go through Apple's usual refund process.
The unlock is tied to the Apple Account that bought it and can be restored on your other devices using that account. Daubby provides a Restore purchases control for this. Reinstalling the app does not require buying it again.
If you delete the app and reinstall it, your remaining trial time is preserved where the device allows it. Trial length, price, and what the purchase unlocks may change for new users, but a purchase you have already made will not be revoked.
5. Accuracy of Scans and Gameplay Assistance
This is the most important section of these Terms. Please read it carefully.
Daubby reads printed cards using automated image recognition. Image recognition is inherently imperfect. Lighting, glare, focus, camera quality, card condition, printing variations, unusual card layouts, and ordinary software error can all cause the App to misread a card.
Cynfi makes no warranty that any scan is accurate, complete, or correct. The App may misread a number, read a number that is not present, omit a number that is present, misidentify a free space, misidentify a card's colour or layout, or fail to recognize a card at all.
Cynfi makes no warranty that the App will correctly track called numbers. Numbers may be recorded incorrectly, numbers may be missed, and the App may fail to alert you that a card is close to or has achieved a winning pattern.
You are solely responsible for verifying every scanned card against the physical card in your hand, and for confirming every called number and every claimed win yourself. Daubby is an aid to your own attention, not a replacement for it. Do not rely on the App as your only record of a card, a call, or a win.
Cynfi LLC is not responsible or liable for erroneous scans, missed or misrecorded balls, missed wins, unclaimed or wrongly claimed prizes, disputes with a bingo hall or its operators, ejection from a venue, or any other consequence whatsoever arising from your reliance on the App or on anything it displays. This applies regardless of the cause, including defects in the App itself.
6. Your Responsibilities
You agree to use the App only for lawful purposes and in accordance with these Terms. You are responsible for complying with the rules of any venue, hall, or game you attend. Many venues restrict or prohibit the use of phones, cameras, or electronic aids during play. It is your responsibility — not Cynfi's — to know and follow those rules and any applicable law before using Daubby anywhere.
You agree to photograph only bingo cards you legitimately possess and are entitled to use.
7. Data and Privacy
Photographs of your cards are processed on your device and stay on your device. Cynfi does not have access to your cards, your game history, or your settings. See our Privacy Policy for full details.
8. Camera Access
Daubby requires camera access to scan cards. You may revoke this permission at any time in your device settings, which will prevent the App from scanning. Cynfi is not responsible for failed or degraded scanning resulting from device limitations, camera hardware, insufficient lighting, or permissions you have disabled.
9. Network Connections and Updates
Daubby contacts a server operated by Cynfi to check for improved card-recognition models and download them if available. Cynfi does not warrant that this service will be available or uninterrupted, and may modify, suspend, or discontinue it at any time. Daubby's scanning and gameplay features are designed to function offline.
10. Intellectual Property
Daubby, the Cynfi name, and all associated logos, designs, models, and content are the intellectual property of Cynfi LLC. All rights are reserved. Nothing in these Terms grants you any rights to use Cynfi's trademarks, logos, or branding.
Daubby is not affiliated with, endorsed by, or sponsored by any bingo hall, game operator, card manufacturer, or gaming authority.
11. Disclaimer of Warranties
Daubby is provided "as is" and "as available" without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Cynfi does not warrant that the App will be uninterrupted, error-free, or free from defects. Your use of the App is at your sole risk.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Cynfi LLC shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost winnings, lost prizes, lost money, lost opportunity, or lost time, arising from your use of or inability to use Daubby, or from any error, omission, or inaccuracy in anything the App displays — even if Cynfi has been advised of the possibility of such damages.
Without limiting the foregoing, Cynfi is not liable for anything you rely on the App to do. Cynfi's total aggregate liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid Cynfi for the App, which for a free download is zero dollars ($0.00).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the above exclusions apply to the fullest extent permitted by law.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Ohio.
14. Changes to Terms
Cynfi reserves the right to modify these Terms at any time. We will update the "Last Updated" date when changes are made. Continued use of the App after changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
15. Termination
You may stop using Daubby at any time by deleting the App from your device. Cynfi reserves the right to discontinue the App or any feature at any time without notice.
